Terms of Service
1. About these terms
Pocket Cartoonist (“we”, “us”) runs pocketcartoonist.com and the Pocket Cartoonist comic maker (the “Service”), including its private beta. These terms are an agreement between us and you, the person who uses the Service. By using it, you accept them. Questions: hello@pocketcartoonist.com.
2. Who can use the Service
An account belongs to an adult: a parent, legal guardian or teacher. Children make comics with the Service under that adult's supervision. The adult accepts these terms for themselves and on behalf of the child, and is responsible for how the child uses the Service.
3. What the Service does
You write a story with help from AI. The Service builds its characters and places for you to approve, suggests scenes and draws them, and lays them out on draft pages, where you polish the words and arrange the pages.
We are responsible for running the Service and for fixing it when it does not work as described. Text and pictures made by AI can be inaccurate or unexpected; you decide what goes into the finished comic.
4. Third-party AI models
The Service works through AI models made by other companies: language models and image generators. The models, and all rights in them, belong to their providers.
Providers apply their own rules on content and copyright. When a model declines a request under those rules, our agent rewrites the request so that it complies with them.
We do not guarantee that generated pictures are free of other people's rights, and we are not responsible for pictures that reproduce copyrighted or trademarked material. You are responsible for what you ask the Service to make and for how you use the result: do not ask for characters, brands or artwork that belong to others, and do not publish or sell comics that use them without permission.
5. Your comics belong to you
The story, the pictures and the finished comic (“your content”) belong exclusively to their author: the child who wrote the story, represented by the account holder. Any rights we may have in the pictures generated for you pass to you. In some countries pictures made by AI may not be protected by copyright at all.
You give us a non-exclusive, worldwide, perpetual, royalty-free licence to store, copy, show, adapt and otherwise use your content to run, improve and promote the Service, and to let our service providers do so on our behalf. We owe no payment or other compensation for this licence. We do not publish a child's name or other personal details without the account holder's permission.
6. Data sent to other services
To make your comic, we send your story, descriptions, choices and pictures to third-party services, including language models and image generators. They process this data under their own terms and privacy policies, which may allow them to use it to train and improve their models. We use these services in line with their policies; how each provider handles the data under its own policy is that provider's responsibility. Details are in the Privacy and Cookie Policy.
Keep real personal details out of stories: home addresses, phone numbers, school names, photos of real people.
7. Acceptable use
- Do not use the Service to make content that is illegal, sexual, hateful, or violent in a way that is unsuitable for children.
- Do not use it to harass or impersonate real people.
- Do not try to get around the Service's safeguards, overload it, or access it other than through the ways we provide.
We may remove content or suspend an account that breaks these rules.
8. Prices
Prices are shown before you order. Nothing is charged during the private beta.
9. Changes
The Service is in development: we may change, pause or end features. We will tell account holders by email about important changes to these terms before they take effect.
10. Liability
The Service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that the law does not allow to be limited.
